II. Definitions
- Business Days – Monday to Friday, excluding public holidays in Poland.
- Civil Code – the Polish Civil Code of 23 April 1964.
- Consumer Rights Act – the Polish Act of 30 May 2014 on consumer rights.
- Customer – a natural person with full legal capacity (or with limited legal capacity, where permitted by law), a legal person or an organisational unit without legal personality to which the law grants legal capacity, who places an Order or uses the Services.
- Consumer – a natural person who concludes a contract with the Seller for purposes not directly related to their business or professional activity.
- Account – a password-protected section of the Online Shop assigned to a registered Customer.
- Newsletter – a Service consisting in sending the Seller's commercial information to the Customer's e-mail address.
- Order – the Customer's declaration of intent to conclude a Sales Agreement, submitted via the Online Shop.
- Product – a movable item offered in the Online Shop.
- Sales Agreement – a contract for the sale of Products concluded between the Seller and the Customer via the Online Shop.
- Services – services provided electronically by the Seller within the meaning of the Polish Act of 18 July 2002 on the provision of services by electronic means.
- Online Shop – the online shop available at www.contigostore.eu.
- Terms – this document.
III. General provisions
- These Terms set out the rules for using the Online Shop, providing the Services and concluding Sales Agreements.
- The Terms are available free of charge at www.contigostore.eu in a form that allows them to be downloaded, displayed, printed and saved at any time.
- To use the Online Shop, the Customer needs a device with Internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active e-mail address.
- Using services provided electronically involves the risks typical of the Internet, such as unauthorised access to data. The Customer should use appropriate security measures, e.g. up-to-date antivirus software.
- The Customer is obliged to:
- provide true, up-to-date and complete data in Orders and registration forms, and update them without delay if they change;
- use the Online Shop in a way that does not disrupt its operation or the use of the Online Shop by other Customers;
- use the Online Shop in accordance with the law and these Terms, and not provide unlawful content.
IV. Electronic services
- The Seller provides the following Services free of charge, 24 hours a day, 7 days a week:
- Account;
- Newsletter;
- placing Orders and concluding Sales Agreements;
- posting reviews (Section XI).
- An Account is created by completing the registration form, accepting these Terms and clicking "Register". The Account agreement is concluded for an indefinite period. The Customer may terminate it at any time, without giving reasons, by sending a request to shop@contigostore.eu or by using the "Delete account" function.
- The Newsletter is provided after the Customer has subscribed and given the required consent. The Newsletter agreement is concluded for an indefinite period. The Customer may unsubscribe at any time using the link in each Newsletter message or by sending a request to shop@contigostore.eu.
- The service of placing an Order is provided once and ends when the Order is placed or when the Customer stops placing it.
- The Seller may terminate an agreement for an indefinite-term Service with 14 days' notice for important reasons, namely: (a) a change in the law affecting the provision of the Services, (b) a change in the scope of the Services, or (c) the Customer's breach of these Terms, if the Customer has not ceased the breach despite being asked to do so within an appropriate time limit.
- Termination of a Service agreement does not affect rights acquired before its termination.
- Complaints about the Services may be sent to shop@contigostore.eu. The Seller will respond within 14 days of receipt.
V. Orders and conclusion of the Sales Agreement
- Product information in the Online Shop, in particular descriptions, technical parameters and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
- Orders may be placed 24 hours a day, 7 days a week, with or without an Account.
- When placing an Order, the Customer provides the data required to perform the Sales Agreement: first name, surname, delivery address, telephone number and e-mail address. If the Order cannot be delivered because the Customer has provided incorrect data, the Seller may charge the Customer the reasonable costs actually incurred for re-delivery.
- Before submitting the Order, the Customer sees a summary including the Products, the total price including taxes, delivery costs and the selected payment method. The Customer submits the Order by clicking the button indicating an obligation to pay.
- Immediately after the Order is placed, the Seller sends the Customer an e-mail confirming receipt of the Order. The Sales Agreement is concluded when the Customer receives this e-mail.
- The total value of the Order consists of the price of the Products and the delivery costs.
- The Sales Agreement is concluded in English. Its content is recorded in the Order confirmation and in these Terms.
VI. Delivery
- Products are delivered to the address indicated by the Customer, to the countries listed on the "Shipping" information page.
- Products are delivered by a courier or parcel delivery company.
- The Order processing time and the delivery time are stated on the Product page and on the "Shipping" information page and are calculated in Business Days. If the Products in an Order have different processing times, the longest time applies to the whole Order.
- Delivery costs are shown on the "Shipping" information page and before the Order is submitted. The Seller may offer free delivery as part of promotions announced in the Online Shop.
VII. Prices and payment methods
- Prices are gross prices including VAT and are given in EUR (or in PLN, if that currency is selected). Prices do not include delivery costs, which are shown before the Order is submitted.
- The Customer may choose from the payment methods shown at checkout, in particular:
- bank transfer to the Seller's account – the Order is shipped after the payment has been credited to the Seller's account;
- credit or debit card;
- PayPal;
- Klarna;
- Stripe.
- Online payments are processed by: Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland; PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg; Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. The detailed rules of each payment method are set out by the respective payment provider.
- Purchase documents (receipt or VAT invoice) are sent to the Customer electronically.
VIII. Right of withdrawal
- A Consumer who has concluded a distance contract may withdraw from it within 14 days without giving any reason and without incurring any costs other than those set out in point 9.
- The withdrawal period begins on the day on which the Consumer, or a third party indicated by the Consumer other than the carrier, takes possession of the Product. If the Order includes several Products delivered separately, the period begins when the last Product is taken into possession.
- To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by an unequivocal statement, e.g. by e-mail to shop@contigostore.eu, by post to the Seller's registered office or via the returns form in the Online Shop. The Consumer may use the model withdrawal form in Appendix 1, but this is not obligatory. To meet the deadline, it is sufficient to send the statement before the withdrawal period expires.
- The Seller will confirm receipt of the withdrawal statement by e-mail without delay.
- In the event of withdrawal, the contract is deemed not to have been concluded.
- The Seller will refund all payments received from the Consumer, including the cost of delivery, without undue delay and no later than 14 days from the day on which the Seller received the withdrawal statement. If the Consumer chose a delivery method other than the cheapest standard delivery offered by the Seller, the Seller is not obliged to refund the additional costs. The refund will be made using the same means of payment as the Consumer used, unless the Consumer has expressly agreed otherwise; in any event, the Consumer will not incur any fees as a result of the refund.
- The Seller may withhold the refund until the Product has been received back or until the Consumer has supplied proof of having sent it back, whichever is earlier.
- The Consumer must send back the Product without undue delay and no later than 14 days from the day on which they withdrew from the contract, to: Red Bird Magazyn, ul. Franciszka Płocka 7, 94-106 Łódź, Poland. The deadline is met if the Product is sent back before the 14-day period expires.
- The Consumer bears the direct cost of returning the Product.
- The Consumer is liable for any diminished value of the Product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.
- The right of withdrawal does not apply to Products made to the Consumer's specifications or clearly personalised, in particular personalised mugs and bottles (e.g. with an engraving or an individual print).
- The provisions of this Section and of Section IX concerning Consumers also apply to a natural person who concludes a contract directly related to their business activity, where it follows from the content of the contract that it is not of a professional nature for that person, in particular in view of the subject of their business activity.
IX. Complaints – non-conformity of Products with the contract
- The Seller is liable to the Consumer for any lack of conformity of the Product with the contract that existed at the time of delivery and becomes apparent within 2 years of delivery. If the mandatory law of the country of the Consumer's habitual residence provides for a longer period (e.g. 3 years in Spain), that longer period applies.
- If the Product is not in conformity with the contract, the Consumer may demand its repair or replacement. The Seller may carry out a replacement instead of the requested repair, or a repair instead of the requested replacement, if the remedy chosen by the Consumer is impossible or would require excessive costs. The Seller will carry out the repair or replacement within a reasonable time and without significant inconvenience to the Consumer.
- The costs of repair or replacement, including in particular postage, transport, labour and materials, are borne by the Seller. The Consumer makes the Product available to the Seller, and the Seller collects it at its own expense.
- The Consumer may declare a price reduction or withdraw from the contract if:
- the Seller has refused to bring the Product into conformity with the contract;
- the Seller has failed to bring the Product into conformity with the contract;
- the lack of conformity persists even though the Seller has tried to bring the Product into conformity;
- the lack of conformity is so serious that it justifies a price reduction or withdrawal without first using the remedies referred to in point 2;
- it is clear from the Seller's statement or the circumstances that the Seller will not bring the Product into conformity within a reasonable time or without significant inconvenience to the Consumer.
- The reduced price must be proportionate to the contract price in the same ratio as the value of the non-conforming Product bears to the value of a conforming Product. The Seller will refund the amount due within 14 days of receiving the Consumer's price-reduction statement.
- The Consumer may not withdraw from the contract if the lack of conformity is minor. A lack of conformity is presumed not to be minor.
- In the event of withdrawal from the contract due to a lack of conformity, the Consumer returns the Product to the Seller without delay, at the Seller's expense, to the address given in Section VIII point 8. The Seller will refund the price within 14 days of receiving the Product or proof of its return.
- Complaints may be submitted by e-mail to shop@contigostore.eu or via the complaint form in the Online Shop. To speed up processing, we recommend including: a description of the lack of conformity, the requested remedy and contact details, and attaching evidence such as photos. This recommendation does not affect the validity of complaints submitted in another form.
- The Seller will respond to a complaint within 14 days of receiving it.
- A commercial guarantee, if granted by the manufacturer or the Seller, is provided on the terms set out in the guarantee statement and does not affect the Consumer's statutory rights.
X. Out-of-court dispute resolution
- The Consumer may use out-of-court complaint-handling and redress procedures. Participation is voluntary and requires the consent of both parties.
- Information on out-of-court consumer dispute resolution in Poland is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl.
- Consumers living in another EU Member State can obtain free help with cross-border disputes from the European Consumer Centre in their country (ECC-Net network). The European Consumer Centre Poland can be found at www.konsument.gov.pl.
- The use of out-of-court procedures does not affect the Consumer's right to bring an action before a court.
XI. Reviews
- A Customer may post a voluntary and free review of a purchase actually made in the Online Shop, including a rating, a photo or a description of the purchased Product.
- The Seller verifies that reviews come from Customers who actually purchased the Product, using the e-mail address used for the purchase or assigned to the Customer's Account.
- Reviews are published in the Online Shop or in an external review service and are visible to all visitors.
- The Seller and its employees do not post reviews. The Seller does not post or commission false reviews or recommendations and does not publish sponsored reviews.
- Concluding fictitious Sales Agreements solely to post a review is prohibited. Reviews must not contain unlawful content or infringe the rights of the Seller or third parties. Reviews that breach these rules may be removed.
- By posting a review, the Customer agrees that the Seller may use it free of charge in the Online Shop.
XII. Force majeure
- Neither party is liable for failure to perform its obligations if the failure is caused by force majeure, i.e. an unforeseeable event beyond its control, such as an epidemic, flood, fire, storm, shortage of raw materials, transport strike, strike or lock-out. The affected party must inform the other party promptly, no later than 5 Business Days after the event occurs.
- While the force majeure event continues, the parties will cooperate to determine how best to perform the Order.
- This Section does not limit the statutory rights of Consumers.
XIII. Personal data
- The Seller is the controller of the Customers' personal data and processes them in accordance with Regulation (EU) 2016/679 (GDPR) and applicable law.
- Detailed information on the processing of personal data is set out in the Privacy Policy available in the Online Shop.
XIV. Final provisions
- All rights to the Online Shop, including copyrights and rights to its name, domain, website, graphics and logos, belong to the Seller or to entities that have authorised the Seller to use them.
- These Terms and the Sales Agreements are governed by Polish law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
- The choice of law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with Consumers are resolved by the courts competent under the generally applicable rules. Disputes with Customers who are not Consumers are resolved by the court competent for the Seller's registered office.
- The Seller may amend these Terms for important reasons, in particular a change in the law, a change in payment or delivery methods, or a change in the scope of the Services. Amendments are published in the Online Shop, and Customers with an Account are also informed by e-mail. Amendments take effect no earlier than 14 days after publication. A Customer with an Account who does not accept the amendments may terminate the Account agreement. Orders placed before the amendments take effect are governed by the previous version of the Terms.
- These Terms are available in English, German, French and Spanish. Each language version applies to Sales Agreements concluded in that language.
